Adventure Connect

IMPORTANT:

Governing law notice: Although this document is written in English for the convenience of our international clients, all services are provided in Argentina and this agreement is governed by Argentine law, in particular the Argentine Consumer Protection Law (Ley 24.240) and the Argentine Civil and Commercial Code (Código Civil y Comercial de la Nación). A Spanish-language version of these Terms is available on our website and, in case of any discrepancy between versions, the Spanish version shall prevail for legal purposes in Argentina.

1. Purpose and acceptance

This document governs the use of the website https://acpatagonia.com/ and the contracting of services offered by Adventure Connect ("AC"), operated by UFR SAS, domiciled in El Chaltén, Santa Cruz Province, Argentina.

Browsing the site and/or booking any package, program, or service implies full reading, understanding, and acceptance of these Terms and Conditions, as well as our Privacy Policy and Cancellation and Refund Policy, which form an integral part of this agreement.

In accordance with Argentine Consumer Protection Law (Ley 24.240, Art. 4), AC guarantees consumers truthful, detailed, clear, and sufficient information about the essential characteristics of the services offered, marketing conditions, and any other relevant circumstance for the contract.

2. Adventure Connect's role

2.1. Adventure Connect is a design, curation, and organization agency for trail running and outdoor experiences in the El Chaltén region. Its activity consists of:

  • Designing itineraries and programs based on local terrain knowledge.
  • Selecting, coordinating, and contracting — on the client's behalf — independent tourism service providers (mountain guides, lodging, transportation companies, excursion operators, food services, among others).
  • Acting as point of contact, logistics organizer, and experience curator.

2.2. Adventure Connect does not directly provide mountain guiding, transportation, lodging, food, or any other operational service included in the packages. These services are provided by independent, licensed, and specialized third parties ("the Providers"), who act under their own professional, technical, and legal responsibility, and who hold the licenses, registrations, and insurance required by applicable regulations for their activity.

2.3. AC selects its Providers based on local expertise, track record, and safety standards, and requires each Provider, as a condition of joining AC's provider network, to hold:

  • Valid authorization to operate in Los Glaciares National Park and/or the relevant activity.
  • Valid civil liability insurance.
  • Compliance with applicable mountain safety protocols.

AC reserves the right to request and verify this documentation, without this implying that AC assumes the obligations proper to each Provider.

3. Nature of risk of the activities — Assumption of risk

3.1. The client acknowledges and accepts that trail running, trekking, and mountain activities in Patagonian terrain involve inherent risks that cannot be eliminated even with the maximum diligence of organizers, guides, and providers, including but not limited to:

  • Sudden and extreme weather conditions typical of Patagonia.
  • Technical, uneven terrain, with elevation changes, exposed sections, and river crossings.
  • Risk of injury from falls, fatigue, dehydration, hypothermia, or altitude effects.
  • Wildlife.
  • Difficulty or delay in accessing emergency medical assistance due to the remote location of the routes.

3.2. The client represents, as a sworn statement, that:

  • They are in a health and physical condition appropriate to the demands of the booked program.
  • They do not have medical conditions that would contraindicate the activity, or have expressly disclosed them to AC prior to booking.
  • They hold travel insurance and/or personal accident insurance with coverage for mountain/trail running activities, valid for the duration of the program. AC may require proof of such insurance as a condition prior to the start of the activity.

3.3. Guides and providers in charge of each activity have the authority to modify, suspend, or cancel any part of the itinerary, in whole or in part, for safety reasons (weather, client condition, terrain conditions, park ranger decisions, etc.), without this generating any right to compensation, without prejudice to what is established in the Cancellation Policy regarding rescheduling or partial refund where applicable.

4. Liability for the provision of services

4.1. Each Provider is the sole direct party responsible for the correct, safe, and professional execution of the specific service they provide (guiding, transportation, lodging, food, etc.), as well as for any damages that may result from negligence, malpractice, or failure to comply with safety standards on their part.

4.2. Adventure Connect will not be liable for acts, omissions, negligence, or breaches attributable exclusively to the Providers, provided AC has fulfilled its duty of diligent selection and information as set out in clause 2.3.

4.3. Notwithstanding the above, and in compliance with applicable consumer protection regulations, AC informs that — pursuant to Art. 40 of Ley 24.240 — Argentine law establishes a regime of joint and several liability among all members of the commercialization chain of a service toward the consumer for damages arising from it, a regime that cannot be modified or waived by contract. This clause is not intended to, and cannot, have the effect of releasing AC from responsibilities assigned to it by law on a mandatory basis; its sole purpose is to make transparent the actual distribution of roles, tasks, and operational responsibility between AC and the Providers.

4.4. AC maintains its own civil liability insurance policy for its organization and intermediary activity.

5. Pricing, payment, and billing

5.1. Published prices are expressed in [USD/ARS] and include the items detailed in each program. They do not include unspecified expenses (international flights, tips, personal expenses, travel insurance, etc.), which is expressly clarified on each product page in accordance with the duty of information under Art. 4 of Ley 24.240.

5.2. A booking is confirmed upon payment of a 30% deposit, and the remaining balance by [day before go], according to the schedule provided at the time of booking.

IMPORTANT: The rates quoted for the services are subject to change by suppliers without prior notice; therefore, fares are not guaranteed until the service is fully confirmed and issued (ticket, voucher, or final confirmation) and payment has been completed.

All services are subject to availability at the time of confirmation.

Rates may include penalties for changes in dates, schedules, cancellations, or refunds, according to the specific conditions of each supplier. Some promotional fares do not allow changes or refunds and require strict compliance with the rules governing their application.

Advance purchase policies for promotional fares are non-negotiable, as airlines and other suppliers use automated systems to control and cancel space that has not been issued within the established deadlines.

5.3. Payments are processed through Stripe. AC does not store credit/debit card data.

6. Right of withdrawal

6.1. In accordance with Articles 1110 to 1116 of the Argentine Civil and Commercial Code (governing distance contracts) and Resolution 424/2020 of the Argentine Secretariat of Internal Commerce, consumers have the right to withdraw from a purchase within ten (10) calendar days of entering into the contract, without needing to state a reason and without any liability, unless the service has already begun with the consumer's express consent.

6.2. The website will feature a "Right of Withdrawal" button ("Botón de Arrepentimiento"), easily accessible, visible, and clearly identified, as required by the aforementioned regulations.

6.3. This right does not apply once the service has begun (for example, if the program has already started) or in cases of exception provided for under applicable regulations.

7. Cancellation and Refund Policy

7.1. Cancellation by the client

20 days before 15% of the reservation total. At AC's discretion, up to 25% of the amount paid may be issued as credit toward a future departure within the following 12 months, subject to availability.
Less than 10 days, or no-show No refund.

8. Intellectual property

The content of this site (text, photographs, logo, design, "Adventure Connect" brand) is the property of AC or used under license, and may not be reproduced without prior written authorization. The Adventure Connect trademark is registered with Argentina's National Institute of Industrial Property (INPI).

9. Personal data protection

9.1. AC processes clients' personal data in accordance with Argentina's Personal Data Protection Law (Ley 25.326). Data collected (name, contact information, health information disclosed for the purposes of the activity, etc.) is used exclusively for booking management, communication, and fulfillment of the contracted service, and is not shared with third parties except for the Providers strictly necessary to carry out the service, or as required by law.

9.2. Data subjects have the right to access, rectify, update, and delete their data, under Art. 14(3) of Ley 25.326, by contacting hola.adventureconnect@gmail.com. Argentina's data protection authority, the Agencia de Acceso a la Información Pública (AAIP), is the enforcement body empowered to handle complaints and claims.

10. Use of Image and Liability

Adventure Connect, its associated providers (guides, operators, lodging) and the photographers designated for each excursion reserve the right to use, reproduce, distribute, and/or publish photographs, videos, recordings, and/or any other means of recording, including social media and the Adventure Connect website, of excursion participants, without any financial compensation owed to them. Each participant's booking shall be interpreted as consent to the use of their own image under the terms described above.

Participation in the excursion implies the participant's responsibility for the data provided on the booking form, full acceptance of the Terms and Conditions, the corresponding health declaration and risk waiver, and payment of the booking.
